One of the most common phone calls and the most common Google search that we receive is for those looking for a mobile mechanic, somebody to come to them at the side of the road, at their place of work or business, or maybe even at home, to service their Denver automobile. Here in the state of Colorado, in 1992, the state invoked the Motor Vehicle Repair Act. The Motor Vehicle Repair Act was designed to protect you, the consumer. It gives you lots of rights and it sets the standard for how you’re supposed to be treated in the auto industry. It sets very basic principles of how services should be performed, how they should be billed, how they should be explained to you, the process for which approvals happen, and some really important nomenclature so that you’re properly taken care of every time. We hear complaints from other facilities about a repair being performed without being authorized or things of this nature. Those are all parts of the Motor Vehicle Repair Act.
One big factor in the Motor Vehicle Repair Act though comes to mobile mechanics. In the state of Colorado, property insurance follows the property. If you own a motor vehicle and you insure it in your name and you let a friend use it, your insurance covers that car no matter what happens because it’s your property that was being insured. If you’re a homeowner and something fails with your house or it’s damaged in a storm, that piece of property, the home, it’s insured, and the policy that follows that home takes care of whatever happens on that home. That’s a really big, important factor.
The reason why is if you hire a mobile mechanic and he comes out to your home or your place of business, he’s operating on that insurance, not yours. If you have a mobile mechanic come out to your home and he’s working on vehicle in your driveway and it falls off the jack stands and crushes him and injures him severely, your homeowner’s insurance is the first person to pay that claim, regardless of whether or not that mobile mechanic was actually bonded or insured by the state. The state’s own laws dictate that where it happened on that property is whose liability it is. Here, too, if that mechanic gets hurt on your property, your property insurance as a homeowner could be paying for it.
If you’re a renter and you’re in an apartment, or you’re at work and they come to do it in your driveway or at your place of business, your owner’s insurance for your motor vehicle could be held liable, should that person be injured, or killed, or worse, while operating on your motor vehicle.
